Le problème du sujet ou de l'intersubjectivité représente, sans aucun doute, une des questions les plus importantes de la philosophie politique et juridique contemporaine. C'est ce que confirme le retour de l'éthique dans nos sociétés démocratiques ainsi que les remises en question de tout concept de subjectivité. Ces dernières pourraient bien servir de fil conducteur à une reconstruction de l'histoire des différents projets modernes de la philosophie. A cette possibilité de reconstruction s'ajouteraient non seulement les différentes tentatives de repenser l'intersubjectivité (...) telles que les ont menées des penseurs comme Husserl, mais encore ses déconstructions opérées par Nietzsche, Heidegger et le heideggerianisme français d'une part, ainsi que les reconstructions entreprises au sein de l'éthique de la discussion (Karl-Otto Apel et Jürgen Habermas). Même le débat, devenu emblématique, de la philosophie politique et juridique anglo-américaine entre libéraux et communautariens tourne autour de la notion de subjectivité. Les théories féministes contemporaines réussiront, elles aussi, à la raviver, à la polariser autour de deux éléments sexuellement différents : le "sujet mâle de la raison" et le "sujet féminin essentiellement caractérisé par la tendance à la sollicitude"? Les théories féministes n'ont-elles pas repris à leur compte le slogan de la fin de l'homme, l'une des plus importantes déclarations de guerre des déconstructions postmodernes de la métaphysique occidentale, notamment des théories modernes? N'ont-elles pas trouvé dans cette déclaration un écho favorable à leur cause, dès lors que l'homme s'identifie au "sujet mâle de la raison", propriétaire chrétien et blanc"? L'importance des problèmes soulevés par le concept de la subjectivité, sa place dans la philosophie contemporaine sans parler des controverses qu'il génère expliquent et imposent ce nouvel investissement auquel nous consentons. L’objet de la présente contribution est d’examiner les relations qu’établissent plusieurs auteurs entre l’amélioration de l’homme, la nature humaine et l’humanisme. Après avoir défini un sens faible et un sens fort du transhumanisme, nous y avons opposé deux critiques, celle de J. Habermas et de M. Sandel, en prenant l’exemple le plus discuté dans la littérature : la possibilité d’améliorer génétiquement son enfant et avons montré qu’elles ne sont pas convaincantes : le recours au concept de la nature humaine à (...) lui seul n’aide pas à répondre à la question de savoir si l’amélioration génétique d’un enfant est morale ou non. Il en est de même de la caractérisation de l’amélioration de l’homme en terme d’humanisme. Loin d’être une justification, il peut aussi s’appliquer à toute position dite bioconservatrice : le transhumanisme peut être humaniste dans le sens heideggérien critique de la technique comme métaphysique. Fowers et al. recently made a general argument for virtues as the characteristics necessary for individuals to flourish, given inherent human limitations. For example, people can flourish by developing the virtue of friendship as they navigate the inherent human dependency on others. This general argument also illuminates a pathway to flourishing during the COVID-19 pandemic, the risks of which have induced powerful fears, exacerbated injustices, and rendered life and death decisions far more common. Contexts of risk and fear call for (...) the virtue of courage. Courage has emerged more powerfully as a central virtue among medical personnel, first responders, and essential workers. Longstanding inequalities have been highlighted during the pandemic, calling for the virtue of justice. When important personal and public health decisions must be made, the central virtue of practical wisdom comes to the fore. Wise decisions and actions incorporate the recognition of relevant moral concerns and aims, as well as responding in fitting and practical ways to the specifics of the situation. Practicing courage, justice, and practical wisdom illuminates a path to flourishing, even in a pandemic. (shrink)

V rámci filosofie věd panuje široká shoda na tom, že druhá polovina 20. století složila „labutí píseň" pozitivismu. Milton Friedman a Paul Samuelson, dva klíčoví autoři k metodologii ekonomie v daném časovém období, přitom tento vývoj ve filosofii vědy prý nikdy nereflektovali. Pozitivistická východiska - v prvé řadě v podobě redukcioni- stického přístupu - jsou tudíž stále přítomna ve vlivných teoretických konceptech rozvinutých ekonomy hlavního proudu. Značný počet autorů však v současnosti sdílí náhled, že tyto koncepty v nezanedbatelné míře přispěly (...) k vývoji, jenž ústil ve finanční krizi, vrcholící v letech 2008 a 2009. Předkládaný článek se proto táže, zda to byla právě krize - v níž mnozí spatřují empirické zamítnutí řady pozitivistických konceptů - která napsala „labutí píseň" pozitivismu v ekonomii hlavního proudu. The key to action control is one’s ability to adequately predict the consequences of one’s actions. Predictive processing theories assume that forward models enable rapid “preplay” to assess the match between predicted and intended action effects. Here we propose the novel hypothesis that “reading” another’s action intentions requires a rich forward model of that agent’s action. Such a forward model can be obtained and enriched through learning by either practice or simulation. Based on this notion, we ran a series of (...) studies on soccer goalkeepers and novices, who predicted the intended direction of penalties being kicked at them in a computerized penalty-reading task. In line with hypotheses, extensive practice in penalty kicking improved performance in penalty reading among goalkeepers who had extensive prior experience in penalty blocking but not in penalty kicking. A robust benefit in penalty reading did not result from practice in kinesthetic motor imagery of penalty kicking in novice participants. To test whether goalkeepers actually use such penalty-kicking imagery in penalty reading, we trained a machine-learning classifier on multivariate fMRI activity patterns to distinguish motor-imagery-related from attention-related strategies during a penalty-imagery training task. We then applied that classifier to fMRI data related to a separate penalty-reading task and showed that 2/3 of all correctly read penalty kicks were classified as engaging the motor-imagery circuit rather than merely the attention circuit. This study provides initial evidence that, in order to read our opponent’s action intention, it helps to observe their action kinematics, and use our own forward model to predict the sensory consequences of “our” penalty kick if we were to produce these action kinematics ourselves. In sum, it takes practice as a penalty kicker to become a penalty killer. (shrink)

This volume re-examines some of the major themes at the intersection of traditional and contemporary metaphysics. The book uses as a point of departure Francisco Suárez’s _Metaphysical Disputations_ published in 1597. Minimalist metaphysics in empiricist/pragmatist clothing have today become mainstream in analytic philosophy. Independently of this development, the progress of scholarship in ancient and medieval philosophy makes clear that traditional forms of metaphysics have affinities with some of the streams in contemporary analytic metaphysics. At the beginning of the 1890s, Schwarz and Peano (independently of each other) showed that Serret’s definition of the area of a surface was flawed. This paper first aims at describing the various methods that the mathematicians have used for correcting Serret’s reasoning; its second goal is to compare and to present more in detail two solutions: Lebesgue’s notorious construction and Peano’s definition.

Recent events at Enron, K-Mart, Adelphia, and Tyson would seem to suggest that managers are still experiencing ethical lapses. These lapses are somewhat surprising and disappointing given the heightened focus on ethical considerations within business contexts during the past decade. This study is designed, therefore, to increase our understanding of the forces that shape ethical perceptions by considering the effects of business school education as well as a number of other individual-level factors (such as intra-national culture, area of specialization within (...) business, and gender) that may exert an influence on ethical perceptions. We found significant effects for business education, self-reported intra-national culture, area of specialization within business, and gender for some and/or all areas of ethics examined (i.e., deceit, fraud, self-interest, influence dealing, and coercion). One of our most encouraging findings is that tolerance for unethical behavior appears to decrease with formal business education. Despite the prevalent stereotype that business students are only interested in the bottom line or that business schools transform idealistic freshman into self-serving business graduates, our results suggest otherwise. Given the heightened criticism of the ethicality of contemporary managerial behavior, it is heartening to note that, even as adults, individuals can be positively affected by integration of ethics training. Offrir une exploration épistémologique des diverses étapes de la recherche scientifique et de la réflexion philosophique sur la matière, tel est le propos qui a régi la composition des neuf études ici réunies. Les différentes conceptions « matérialistes » dans les sciences physiques et biologiques y sont mises en rapport avec les savoirs de chaque période, depuis le temps d'Averroès jusqu'au XIXe siècle.

Le hiéron Σ7 mis au jour en 1990 à Messène est susceptible d'être identifié avec celui de l'héroïne éponyme Messéné ; les vestiges correspondent d'une manière satisfaisante aux données de Pausanias, dont le témoignage se trouve éclairé, et aux indications des inscriptions. Parmi les trouvailles, un fragment de figurine pourrait représenter Messéné. La portée de l'identification est seulement évoquée. Il semble que l'attribution du temple central de l'Asklépieion à Asklépios, contestée au profit de Messéné, puisse être admise ; en outre, (...) l'Asklépieion apparaissant plus «normal», un des obstacles qui empêchent certains de lui reconnaître une activité thérapeutique s'efface, peu après que des signes positifs de celle-ci aient été fournis par la découverte d'un bain. Parmi les questions qui restent à éclaircir à propos du hiéron de Messéné figure celle de ses rapports avec l'Artémision Κ installé à l'arrière du portique Ouest de l'Asklépieion. (shrink)

Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

Příspěvek se věnuje problematice antického řeckého sportu, konkrétně významu sportovních zápolení a jejich výchovné a vzdělávací roli. Pozornost autor věnuje rozboru pozic filosofů Sókrata, Platóna a Aristotela. Po nastínění kontextu tématu představuje a interpretuje základní filosofické a náboženské premisy sportovního výkonu a jeho výchovné role. Řadí mezi ně úsilí o dosažení božské přízně, nesmrtelnosti, vyššího společenského postavení, ale i ideálů kalokagathia, areté a dalších ctností. Důležitý rozměr antického sportu spatřuje rovněž v jeho formativním potenciálu směřujícímu k přípravě na duševní život. (...) Hlavní část příspěvku se věnuje přístupu k pohybovým zápolením u filosofů Sókrata, Platóna a Aristotela, kteří svými úvahami k chápání výchovné role sportu podstatně přispěli. Následně se autor zaměřuje na identifikaci dobrého sportu podle zmíněných myslitelů a na zkoumání role sportu v kontextu dobrého života, který nahlíží v aristotelském rámci jako dosahování blaženosti. Cílem textu je identifikovat a vyzdvihnout výchovný smysl sportování, poukázat na jeho filosofické konotace a možnou roli sportu v otázce vedení dobrého života. ----------- This manuscript deals with the problematics of ancient Greek sport, specifically with the significance of sporting practices and their educational role. Attention is given to a detailed analysis of the positions of the philosophers Socrates, Plato, and Aristotle. After demonstrating the context, the author presents and interprets fundamental philosophical and religious premises of the athletic performance and its educational role. Among the identified features are the effort of acquiring divine favour, immortality, higher social status, but also the ideals of kalokagathia, areté, and other virtues. Important dimension of ancient Greek sport is also found in its formative potential which aims at the preparation for intellectual life. The main part of the article is focused on the approaches of the philosophers Socrates, Plato, and Aristotle towards the sporting practices. These thinkers made an important contribution to the understanding of the educational role of sport. Then, the author identifies a good sport according to these thinkers and examines the role of such sport in the context of a good life, which is considered in the Aristotelian perspective as achieving beatitude (eudaimonia). The aim of this article is to identify and highlight an educational purpose of sport, underlines its philosophical connotations, and demonstrate its possible role in the context of a good life. Can machine intelligence do clinical ethics? And if so, would applying it to actual medical cases be desirable? In a recent target article (Meier et al. 2022), we described the piloting of our advisory algorithm METHAD. Here, we reply to commentaries published in response to our project. The commentaries fall into two broad categories: concrete criticism that concerns the development of METHAD; and the more general question as to whether one should employ decision-support systems of this kind—the debate we set (...) out to ignite with our target article. Autor v tomto článku rozporuje pojem non-agrese Murrayho N. Rothbarda a využívá při tom to, co nazývá paradoxem non-agresivní vraždy. Autorovou ambicí není nic menšího než rozbít základy Rothbardovy politické filosofie a využívá přitom důkaz sporem, tedy fakt, že vyvrácení kontradiktorního opaku jako nepravdivého je za podmínek úplné disjunkce zároveň důkazem pravdivosti dokazované teze. Dokazovanou tezí je zde teze: v určitých případech existují pozitivní práva a povinnosti, tedy práva a povinnosti nevyplývající ani ze smlouvy, ani z předešlé agrese. O této (...) skupině práv a povinností však Rothbard říká, že ve skutečnosti neexistuje. Důvodem dle Rothbarda je, že takováto pozitivní práva a povinnosti by porušovaly sebevlastnictví povinovaného, resp. jeho právo k vlastní osobě a majetku. Autor tohoto článku naopak jejich existenci dokazuje poukazem na nepravdivost kontradiktorního opaku („pozitivní práva nikdy neexistují“), kterou ukazuje na uvedených paradoxech obklíčitele, majitele člunu, hostitele a skokana. Určité konkrétní majetkové právo nemůže mít subjekt A i subjekt B současně a ve stejném rozsahu. Zatímco však Rothbard tvrdí, že majetkové právo může vyplývat pouze ze smlouvy či z předchozí agrese (jako právo na kompenzaci), autor tohoto článku argumentuje, že majetkové právo nemusí vyplývat pouze ze smlouvy či z předchozí agrese, a dokazuje to existencí případů, kdy popření mimo-smluvního majetkového práva implikuje paradox non-agresivní vraždy: subjekt, který naplánuje úkladnou vraždu, se nedopouští protiprávní agrese. Což je rozpor. Ergo, teze „pozitivní práva nikdy neexistují“ je nepravdivá. Ergo, pravdivá je autorem dokazovaná teze. Mimo-smluvní práva a povinnosti se tedy nachází v obsahu správně pojatého pojmu sebevlastnictví a úkladná vražda se nikdy nenachází v rozsahu správně pojatého pojmu non-agrese. (shrink)

In their Target Article, Rahimzadeh et al. (2023) discuss the virtues and vices of employing ChatGPT in ethics education for healthcare professionals. To this end, they confront the chatbot with a moral dilemma and analyse its response. In interpreting the case, ChatGPT relies on Beauchamp and Childress’ four prima-facie principles: beneficence, non-maleficence, respect for patient autonomy, and justice. While the chatbot’s output appears admirable at first sight, it is worth taking a closer look: ChatGPT not only misses the point when (...) applying the principle of non-maleficence; its response also fails, in several places, to honour patient autonomy – a flaw that should be taken seriously if large language models are to be employed in ethics education. I therefore subject ChatGPT’s reply to detailed scrutiny and point out where it went astray. (shrink)
